What is the difference between a seizure auction and an execution auction?
While both types of auctions aim to collect debts, the main difference lies in the cause. A seizure auction takes place when a creditor has seized goods and sells them through an auction to recover the debt. An execution auction usually involves the forced sale of real estate by a mortgage holder, often a bank. In general, during a seizure auction, the seller cannot guarantee whether or not tenants are present. A mortgage holder can often invoke the "rental clause" (cancel the rental agreement), whereas a creditor enforcing a seizure cannot. Otherwise, there are no differences for buyers at the auction: the bidding process and auction terms are typically the same.
Can a private offer be made in a seizure auction?
In a seizure auction, private offers cannot be made before the auction. However, in an execution auction (mortgage auction), private offers are allowed.
What does "approval" mean?
In an auction, the sellers of real estate have the right to approve the sale. This means that the seller (auctioneer) decides after the auction whether the real estate will actually be sold to the highest bidder. If the seller does not approve, the sale does not proceed, and the buyer does not incur any costs. If the seller approves, the purchase agreement is finalized. The approval period is specified in the auction terms.
